BPOM and Police Uncover Illegal Imported Cosmetics Online Store

BPOM Chief Taruna Ikrar, accompanied by personnel from the Metro Jaya Regional Police and the Indonesian National Armed Forces Strategic Intelligence Agency (BAIS TNI), held a press conference titled “BPOM and Police Uncover Illegal Imported Cosmetics Online Store” at the Jakarta BPOM Office (10/28/2024).

Several high-ranking officials attended the event, including Deputy of Enforcement Rizkal, Jakarta BPOM Chief Sofiyani Chandrawati Anwar, and representatives from Customs, Military Intelligence, Police, and the Prosecutor’s Office.

The press conference showcased enforcement results based on public information about illegal cosmetics sales through the “Kimberlybeauty88” account. Officials raided two warehouse locations in West Jakarta on Thursday, October 24, 2024, uncovering illegal imports.

Warehouse Raid Uncovers Unauthorized Products

Officers discovered 158 items (152,744 pieces) of unauthorized cosmetic products from brands Lameila and SVMY, imported from China. The products, imported through a forwarding service, had an estimated value exceeding 2.2 billion rupiah. The warehouse contained ready-to-ship imported cosmetics packages, electronic devices, and online transaction documents.

The 25-year-old online store owner (identified as FS) had been selling cosmetics on Shopee and Tokopedia platforms for approximately one year, processing around 400 shipments daily. The seized products mainly consisted of facial makeup items like powder, lipstick, eye shadow, eyeliner, and mascara. Officials suspect these illegal products contain prohibited coloring agents (Red K-3 and Red K-10), which can cause skin cancer, liver cancer, and liver dysfunction.

BPOM’s Continued Efforts to Safeguard Consumers

BPOM will conduct further investigations in coordination with police investigators. The perpetrator faces charges under Article 435 jo. Article 138 paragraph (2) of Law Number 17 of 2023 concerning Health, with a maximum prison sentence of 12 years or a fine of up to 5 billion rupiah.

Throughout 2024, the Jakarta BPOM has handled six cases, including five pharmaceutical cases and one food case. Two of these cases involved illegal cosmetics with evidence valued at 5.8 billion rupiah. In September 2024, BPOM and the Ministry of Trade also seized illegal imported cosmetics worth more than 11.4 billion rupiah.

The cosmetics business represents a strategic and potential sector for Indonesia’s economic growth. BPOM notes that over 50% of approved product distribution licenses in the past five years were for cosmetic products. However, businesses must operate within safety and health regulations to avoid illegal imports.

Chief Taruna emphasized that BPOM’s strict enforcement aims to protect both SMEs and industries by taking action against illegal products. He stressed the importance of synergy between government regulators, business operators, and consumers.

He advised business operators to comply with regulations and reminded them of their responsibility for product safety and quality.
